Charity Handling Terms
DRAFT, for Mark/solicitor review. This is a working draft prepared from the decisions of 1 October 2026. It is not final legal text and it is not legal advice. Every point marked [TO CONFIRM: …] is still open.
1. About these terms
These terms are an agreement between RIP Funerals Limited t/a RIP Ireland ("RIP Ireland", "we", "us") and the funeral home named in the onboarding form ("the Funeral Home", "you").
- They apply in addition to the Funeral Home Partner Terms, whenever you choose a charity for support on a Wall. Words defined in the Partner Terms have the same meaning here.
- You accept them by ticking the box and signing electronically. We record the name of the person signing, the date and time, and the version of these terms that was signed.
2. Choosing where support goes
- For each Wall, the funeral director chooses where support payments go: towards funeral costs, or to a charity.
- Choose a charity only with the Family's agreement, and only the charity the Family has chosen. [TO CONFIRM: how the Family's agreement and choice of charity are recorded]
- The Wall shows the name of the charity and makes clear that the Funeral Home is collecting on the charity's behalf. [TO CONFIRM: the exact wording shown to supporters]
- [TO CONFIRM: whether the choice can be changed after support has been received, and what happens to money already given]
3. Charities are not on the Platform
- No charities are onboarded onto the Platform. The charity is not a party to these terms, and RIP Ireland has no agreement with it.
- The charity does not receive money directly through the Platform. The Funeral Home passes the money on, as set out below.
- [TO CONFIRM: whether the Funeral Home must check that the charity is registered, for example by recording its Charities Regulator registration number]
- [TO CONFIRM by solicitor: whether collecting on a charity's behalf needs the charity's permission, and any obligations under Irish charity and fundraising law]
4. Receiving support on the charity's behalf
- Support payments on a charity Wall are paid to your funeral home's Stripe account in the same way as other support payments.
- You receive this money on behalf of the charity. It is not income of the Funeral Home. It must not be used towards funeral costs, and it must not be set off against anything owed to you or to us.
- Keep a clear record of the money received for each charity Wall. [TO CONFIRM by solicitor: whether a separate bank account, or trust or agency wording, is required]
- The support fee in the Partner Terms applies. [TO CONFIRM: whether the 7.5% fee is added on top for the person supporting or deducted from the amount, and whether a different fee applies to charity Walls]
- [TO CONFIRM: any tax or receipting points, for example whether supporters can be given a receipt]
5. Handing the money over
- Pass the full amount received for the charity to the charity within [TO CONFIRM: the time limit, for example a number of days after the Wall closes or after Stripe pays the money out]. If the support fee is deducted, the full amount means the amount after that fee.
- Record each handover on the Platform: the date, the amount and a reference (for example the bank transfer reference or the charity's receipt number).
- Money may be handed over in more than one payment. Record each one.
- Keep evidence of each handover, such as a bank statement or the charity's receipt, for [TO CONFIRM: how long handover evidence must be kept], and show it to us or to the Family if asked.
- If you make a mistake in a recorded handover, correct it promptly. [TO CONFIRM: whether corrections need our approval, and that the Platform keeps a record of each change]
6. What the Family sees
- The Family can see the total received for the charity and each handover you record, with its date, amount and reference.
- [TO CONFIRM: whether totals are also shown publicly on the Wall]
- [TO CONFIRM: whether totals may be shared in posts on county and national social media pages, and with whose consent]
7. Refunds and problems
- [TO CONFIRM: how a supporter's refund request is handled before the money has been handed over, and after]
- If the charity cannot accept the money (for example because it has closed), agree another charity with the Family before handing it over, and record what was agreed. [TO CONFIRM: the process when the Family cannot be reached]
- [TO CONFIRM: what happens if a handover is not recorded within the time limit, for example whether we may pause support payments on that Wall]
8. Our role
- We provide the tools to choose a charity, collect support, record handovers and show them to the Family.
- We do not hold the charity money, pass it on, or check handovers beyond the records you enter. [TO CONFIRM: whether RIP Ireland makes any checks, for example spot checks of handover evidence]
9. Personal data
- Handover records contain the charity's name, the amounts and the references. Supporters' names may be shared with the Family as described in our Privacy Policy.
- [TO CONFIRM by solicitor: whether supporters' names or details may be passed to the charity]
10. Liability and ending
- You are responsible for money you receive on a charity's behalf until it has been handed over. [TO CONFIRM by solicitor: liability and indemnity wording]
- Your duty to hand over and record money already received continues after these terms or the Partner Terms end.
