RIP Ireland Terms and Conditions

Effective Date: 16th April 2025

These Terms and Conditions govern the use of the RIP Ireland Donation Platform, operated by RIP Funerals Ltd (Company No. 760982), trading as RIP Ireland. All individuals accessing, using, donating through, or receiving funds from the platform agree to be legally bound by these Terms under the laws of the Republic of Ireland.

 

1. Purpose and Structure of the Platform

RIP Ireland exists to offer a secure, transparent, and legally compliant donation facility that connects the public with families in need of funeral support. Our platform offers a direct and safe alternative to informal fundraising, where every donation is:

  • Directed to a nominated funeral director or registered charity, never to private bank accounts;
  • Processed securely through authorised payment providers;
  • Backed by structured terms that ensure fairness, legality, and traceability.

Donors should be aware that RIP Ireland does not act as a trustee nor hold funds in escrow or trust. Donations are transferred directly to the nominated funeral director or charity, minus a 2.5% platform and 1.5% bank processing fee. Additional bank fees may apply depending on the payment method.

 

2. Agreement Between Parties

2.1 Platform Users

This includes Donors, Families/Nominators, Funeral Directors, Charitable Organisations, and other individuals using our platform in any capacity. By using RIP Ireland, each party agrees to abide by these terms, which form a legally binding contract.

Age Restriction: Donations may only be made by individuals who are 18 years or older. By submitting a donation, the user confirms they meet this requirement.

Donor Identity: RIP Ireland does not verify the identity, intent, or relationship of individual donors. Donors must act in good faith, and we reserve the right to report or block transactions that appear suspicious or malicious.

2.2 Nomination of Beneficiaries

The family member or legal representative initiating a fundraiser (the “Client”) nominates their chosen funeral director or charity. This nomination is considered final unless a written dispute is received and validated by RIP Ireland.

2.3 Target Amounts and Oversight

The Client sets a target donation amount. RIP Ireland monitors donation progress and notifies stakeholders of milestones. Where targets are exceeded, funeral directors must offer families a full account of services rendered, additional services offered, or provide a formal credit note.

 

3. Financial Flows and Responsibilities

3.1 Direct Transfers

Funds raised are transferred directly to the nominated funeral director or charity. RIP Ireland does not hold donations in trust nor delay payment unless fraud or legal disputes are reported.

3.2 Fee Structure

A 2.5% platform fee is applied to each donation. This covers:

  • Platform development and maintenance;
  • Transactional security and compliance;
  • Customer service and support facilities;
  • Ongoing investment in transparency tools.

Standard banking and payment processor fees may also apply and are visible before payment confirmation.

3.3 Use of Funds

Funds must be used solely for:

  • Payment for funeral arrangements of the named deceased;
  • Funeral-related goods and services;
  • Donations to registered charities, where nominated.

In all cases, the value of donations must be honoured through the provision of goods, services, or an official credit note. No funeral director may profit from donations by withholding or misapplying funds.

3.4 Refund and Dispute Handling

In cases of cancellation, error, or family dispute:

  • RIP Ireland will review complaints within 7 working days;
  • Refunds or reallocations may be issued where reasonable, after platform review;
  • Funeral directors must comply with RIP Ireland’s decision, which will be based on fairness and documented evidence.

Donors are not entitled to refunds unless funds are proven to have been misused or incorrectly allocated.

 

4. Platform Rules and Conditions of Use

4.1 Use for Funeral Purposes Only

The donation platform must be used exclusively for the benefit of funeral arrangements or nominated charities. No other fundraising, advertising, or financial solicitations are permitted.

4.2 Nomination Declaration

By nominating a funeral director or charity, the Client confirms:

  • They have the authority to represent the family or estate;
  • They are acting in good faith;
  • They understand donations are final and bound to the chosen recipient.
4.3 Authority and Consent

It is the responsibility of the Client and the nominated funeral director or partner to ensure that all written content, imagery, family details, and personal data included on any death notice or donation listing are accurate, truthful, and used with full consent. RIP Ireland is not responsible for verifying or editing submitted materials and disclaims any liability for errors or omissions.

4.4 Prohibited Conduct

Users may not:

  • Collect donations for non-funeral causes;
  • Attempt to redirect or reclaim donations after transfer;
  • Publish misleading or false statements on RIP Ireland;
  • Circumvent platform fees or request alternative payment outside of RIP Ireland’s system.

Violation of these terms may lead to account suspension, permanent removal, or legal referral.

4.5 Next of Kin and Message Management

The funeral director may nominate up to three next of kin to manage messages of condolence on notices through the RIP Ireland platform. RIP Ireland facilitates the hosting of these messages but does not assume any duty to moderate, delete, or verify every comment or tribute. If a user finds content inappropriate or incorrect, they are encouraged to report it for manual review.  Negative messages are not welcome at RIP Ireland, we encourage all nominated users to moderate messages closely.  Once a funeral director nominates moderators to manage messages, it becomes their responsibility to ensure messages are deleted if deemed unsuitable.  RIP Ireland should always remain a positive space, we will remove users who do not follow our guidelines.

4.6 Continuous Improvement

RIP Ireland consults with legal, financial, and ethical advisors to refine this service. We remain committed to leading best practice in transparency and dignity within the funeral industry.

4.7 A Model for Modern Funeral Giving

RIP Ireland believes in setting the standard for responsible giving in times of loss. Our system provides families with both financial relief and peace of mind. Donors can trust that their contributions are meaningful, traceable, and protected.

This donation framework is the first of its kind in Ireland and reflects our belief that generosity and accountability must go hand in hand. By using our platform, you join a movement that upholds respect, integrity, and compassion in every transaction.

 

5. Risk Management and Safeguards

5.1 Fraud Detection and Prevention

RIP Ireland uses advanced fraud detection software in collaboration with our payment processors. Transactions are monitored in real-time to identify suspicious behaviour, including:

  • Multiple rapid donations from the same source;
  • Misrepresentation of fundraising purposes;
  • Use of unauthorised accounts or false identities.

Where concerns arise, RIP Ireland reserves the right to suspend the fundraiser and initiate an investigation before any funds are released.

5.2 Due Diligence on Funeral Directors and Charities

All funeral directors and charities using the platform must be verified through:

  • Company registration checks (e.g., CRO or Charity Regulator);
  • Valid bank account matching their registered trading name;
  • Confirmation of VAT and Revenue compliance (where applicable).

Failure to meet verification standards will result in disqualification from the platform.

5.3 Accountability and Reporting

To ensure accountability:

  • Funeral directors must issue a receipt for all goods and services provided using donations;
  • Charities must confirm funds received and report how they were applied upon request;
  • Families can request a usage statement showing how the donation was allocated.
5.4 Donor Protection and Transparency

Donors are entitled to:

  • Confirmation of where their donation was sent and who received it;
  • Full clarity on the 2.5% platform and 1.5% banking fees applied;
  • Reporting channels for any misuse, which RIP Ireland will investigate within 7 working days.

Where misuse is proven, RIP Ireland reserves the right to initiate chargebacks, refunds, or formal complaints.

5.5 Compliance and Legal Authority

All platform activity is governed by Irish law. RIP Ireland may provide information to authorities where required, and will report any activity that may constitute:

  • Fraud or theft;
  • Misuse of charitable funds;
  • Breaches of contract or consumer protection law.

6. Platform Access, Data Use, and Intellectual Property

Marketing and Communications: By using RIP Ireland, users agree to receive platform-related communications via email, including transaction confirmations, fundraising updates, and service announcements. Users may opt out of promotional communications via provided unsubscribe links.

6.1 User Access and Eligibility

To access RIP Ireland, users must be:

  • Over 18 years of age;
  • Acting on behalf of themselves or with the legal authority of a deceased person’s estate or charity;
  • Providing accurate, current, and complete information during sign-up and platform interaction.

RIP Ireland may reject or terminate any account that provides false information or misuses the platform in any way.

6.2 Account Responsibility and Security

Users are responsible for maintaining the confidentiality of login credentials and for all activities conducted through their account. Users must:

  • Keep contact and bank details updated;
  • Report any unauthorised use of their account;
  • Avoid sharing account access with unauthorised parties.

RIP Ireland reserves the right to suspend accounts in cases of suspicious activity, pending investigation.

6.3 Use of Platform Data

All data entered or generated on RIP Ireland – including donation records, fundraiser pages, donor names (where not anonymous), and communication logs – remain the property of RIP Ireland. This data may be used for:

  • Platform administration and analytics;
  • Internal auditing and compliance;
  • Legal reporting where necessary.

We will not sell or share personal data with third parties except under Irish law, or with consent of the data subject, as per our Privacy and Cookies Policies.

6.4 Intellectual Property

All content, branding, coding, systems, and tools created by or for RIP Ireland are protected by copyright, trademark, and intellectual property laws. This includes:

  • Text and website content;
  • Visual assets and design;
  • Codebase, backend systems, databases, and software logic.

Users may not copy, reproduce, or reuse any part of RIP Ireland without written permission. Legal action will be taken in cases of intellectual property theft or misrepresentation.

6.5 Public Listings and Removal Requests

RIP Ireland may publish funeral-related fundraisers on its website and other affiliated pages for transparency and visibility. The family or legal representative may request the removal of listings by written notice, subject to verification of identity and authority.

7. Platform Liabilities and Disclaimers

Service Availability: RIP Ireland does not guarantee uninterrupted or error-free operation of the platform. Service may be temporarily suspended without notice for security, maintenance, or technical issues. We are not liable for any loss or inconvenience caused by such disruptions.

7.1 Limited Liability

RIP Ireland shall not be liable for:

  • Disputes between clients and funeral directors concerning service quality or delivery;
  • Errors or omissions in donation campaigns submitted by users;
  • Third-party payment processor delays or technical issues.

Our responsibility ends upon the secure and compliant transfer of donations to the nominated recipient.

7.2 No Guarantees

RIP Ireland does not guarantee:

  • That a campaign will meet its financial goal;
  • Continuous platform availability or uninterrupted service;
  • Protection from all possible fraudulent activity despite preventative measures.

We provide the platform “as is” and make no warranties beyond our stated responsibilities in these Terms.

7.3 Force Majeure

We shall not be held responsible for delays, outages or failures resulting from:

  • Acts of God, pandemics, or natural disasters;
  • Regulatory changes, cyberattacks or server failures;
  • Strikes, riots or war.

In such cases, we will act in good faith to resume services as quickly as possible.

7.4 Indemnification

All users agree to indemnify RIP Ireland and its directors, staff, and partners from any liability, loss, or cost arising from:

  • Misuse of the platform;
  • False information submitted by the user;
  • Any breach of these terms or applicable laws.

Users will cooperate in any legal proceedings brought against or by RIP Ireland in connection with such matters.

7.5 Amendments and Updates

We may update these Terms to reflect:

  • Legal, technical, or commercial changes;
  • Platform functionality improvements;
  • Feedback from users or regulators.

Users will be notified of significant changes 14 days in advance via email and platform notice.  Users are also advised to contact us if they have not been notified of significant changes.

8. Termination of Access

8.1 Grounds for Termination

RIP Ireland reserves the right to terminate or suspend access for any user who:

  • Breaches these Terms;
  • Submits false or fraudulent information;
  • Attempts to bypass our platform security;
  • Disrupts the integrity of the donation process or damages public trust.
8.2 Notification and Appeal

Where possible, users will be given written notice and an opportunity to respond before termination. Appeals can be made by email to our designated compliance officer and will be reviewed within 10 working days.

8.3 Post-Termination Responsibilities

Upon termination:

  • Outstanding transfers may be withheld pending investigation;
  • User access will be revoked;
  • Legal or regulatory bodies may be informed if applicable.

RIP Ireland is not responsible for any losses resulting from the lawful termination of platform access.

9. Cookies, Contact and Complaints

9.1 Cookie Use and Consent

RIP Ireland uses cookies to enhance site functionality and improve user experience. By using our site, you consent to the placement of cookies on your device unless disabled in your browser settings. Cookies help us:

  • Track anonymous site usage;
  • Improve donation form loading speeds;
  • Analyse site performance for future enhancements.

No personally identifiable information is collected without express consent.

9.3 Formal Complaints Handling

We take complaints seriously. Users can file a formal complaint by writing to our compliance team. All complaints will be:

  • Acknowledged within 3 working days;
  • Investigated thoroughly and impartially;
  • Resolved or responded to within 15 working days.

Where unresolved, complaints may be escalated to the Data Protection Commission, Charities Regulator, or appropriate authority depending on the issue.

10. Additional Legal Safeguards and Governance

10.1 Severability

If any clause or part of these Terms is found to be invalid or unenforceable by a court, the remaining sections shall continue to apply in full force.

10.2 No Waiver

Failure by RIP Ireland to enforce any provision of these Terms at any time shall not constitute a waiver of future enforcement of that or any other provision.

10.3 Governing Law and Jurisdiction

These Terms are governed by Irish law. All disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.

10.4 Assignment and Delegation

RIP Ireland may assign, transfer, or subcontract its rights and obligations under these Terms without prior notice. Users may not assign their rights without prior written consent.

10.5 Entire Agreement

These Terms constitute the full and exclusive agreement between RIP Ireland and the user. No verbal or written statement outside of these Terms shall override or contradict them.

10.7 Force Majeure

RIP Ireland shall not be held liable for any delay or failure in performance due to events or circumstances beyond its reasonable control, including natural disasters, pandemics, strikes, internet outages, or acts of government.

10.8 Non-Partnership and Independence

These Terms do not create any partnership, joint venture, or employer-employee relationship between RIP Ireland and any User.

10.9 Language

These Terms are written in English and shall prevail in case of conflict with any translated version.

11. Extended Compliance, Risk and Regulatory Provisions

11.1 Fraud and Identity Verification

RIP Ireland employs a multi-level verification process for all fund initiators and recipients. This includes:

  • Real-time ID checks via verified third-party services;
  • Ongoing monitoring of transactions for red flags and anomalies;
  • Cooperation with law enforcement for any report of suspicious activity.

RIP Ireland reserves the right to request identity documentation, death certificates, or funeral booking confirmations where necessary.

11.2 Anti-Money Laundering (AML) and KYC Compliance

RIP Ireland is committed to preventing financial crime and meeting obligations under Irish and EU Anti-Money Laundering legislation. We:

  • Monitor donation flows for patterns consistent with smurfing, layering, or obfuscation;
  • Require enhanced due diligence for any fundraisers over €10,000 or involving overseas payment sources;
  • Report suspicious activity to the relevant authorities including An Garda Síochána and the Revenue Commissioners.
11.3 Financial Services Exemption

RIP Ireland is not a bank, financial intermediary, trust manager, or charitable entity. We do not:

  • Offer investment, savings, or financial products;
  • Advise on inheritance tax, estate planning, or wealth management;
  • Hold funds on behalf of donors or beneficiaries.
11.4 Regulatory Reporting

Where legally required, RIP Ireland will report:

  • Suspicious or large transactions in line with AML laws;
  • Fraudulent activity or criminal misuse of the platform;
  • Donations made in breach of international sanctions or terrorist financing rules.
11.5 Donation Cap Policy

To mitigate misuse, RIP Ireland reserves the right to impose:

  • Limits on individual donations (e.g. maximum €10,000 per donation);
  • Limits on total campaign amount unless authorised by RIP Ireland;
  • Temporary suspensions pending review of suspicious patterns or spikes.

 

12. Intellectual Property and Content Ownership

RIP Ireland is not responsible for verifying the accuracy or completeness of any content submitted by users, including names, images, and tribute messages. Responsibility rests solely with the submitting party.

12.1 Ownership of Platform Content

All design elements, software, text, data, graphics, photographs, videos, and other materials used on or through RIP Ireland are the intellectual property of RIP Funerals Ltd or its licensors. This content is protected by copyright, trademark, and other applicable laws. Users may not copy, reproduce, distribute, or create derivative works from any part of the platform without express written permission.

12.2 User-Generated Content

By uploading or submitting any content (e.g. photographs, tributes, names of the deceased), Users:

  • Warrant that they have full rights and authority to share such content;
  • Grant RIP Ireland a royalty-free, perpetual licence to use the content for the purposes of displaying the fundraiser and promoting the platform;
  • Acknowledge that RIP Ireland may retain archived versions for audit and legal compliance.
12.3 Restrictions and Prohibited Use

Users may not:

  • Misuse the RIP Ireland brand, logo, or domain;
  • Use any platform content for misleading or unlawful activity;
  • Impersonate RIP Ireland or claim affiliation without permission.

RIP Ireland reserves the right to remove or suspend any content that breaches these terms or that it deems offensive, illegal, or misleading.

13. Payment Disputes, Chargebacks, and Recovery Actions

13.1 Donor-Initiated Disputes

If a donor disputes a payment (a “chargeback”) with their financial institution:

  • RIP Ireland will review all details associated with the transaction, including the fundraiser page, payment confirmation, and any correspondence;
  • Where the fundraiser has already been fulfilled (i.e. the funeral or charity has received funds), RIP Ireland reserves the right to contest the chargeback with the donor’s bank or card provider;
  • In some cases, RIP Ireland may contact the donor for clarification and to confirm their intentions.

Note: All donations are considered final unless there is clear evidence of fraud, technical error, or unauthorised use.

13.2 Authority to Contest Disputes

By donating through RIP Ireland, donors authorise RIP Ireland to:

  • Engage directly with financial institutions to defend the legitimacy of transactions;
  • Share relevant user and transaction data, including personal data, with payment processors and fraud protection services as necessary;
  • Take all necessary steps to recover disputed amounts that were already disbursed to funeral directors or charities.
13.3 Consequences for Funded Beneficiaries

Where a chargeback is successful and funds have already been transferred:

  • RIP Ireland reserves the right to reclaim the equivalent amount from the nominated funeral director or charity;
  • If funds are unrecoverable, the associated fundraiser may be suspended or removed from the platform, and the funeral director may be delisted pending investigation;
  • RIP Ireland may initiate legal proceedings if funds are withheld or used contrary to the stated fundraiser purpose.
13.4 Non-Cooperation

Where a user, donor, or beneficiary:

  • Refuses to engage in good-faith resolution of a dispute;
  • Deliberately obstructs investigation processes;
  • Or provides false or misleading information—

RIP Ireland reserves the right to:

  • Freeze any current or future fundraisers;
  • Inform relevant authorities or payment partners;
  • Pursue civil recovery of any sums lost or misallocated.
13.5 Regulatory and Tax Considerations

All payment reversals or recovery actions will be recorded and may be disclosed to tax authorities or regulators where required by law. Users are advised to maintain accurate records and ensure compliance with revenue, probate, and other applicable regulations.

14. Governing Law, Jurisdiction and Legal Notices

14.1 Governing Law

These Terms shall be governed exclusively by the laws of the Republic of Ireland, without regard to conflict of law provisions. Users accessing the RIP Ireland platform from other jurisdictions do so at their own risk and are responsible for compliance with their local laws.

14.2 Jurisdiction

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts. By using the platform, users agree to submit to the jurisdiction of the courts of Ireland in respect of all proceedings, disputes or claims.

14.3 Language and Interpretation

These Terms are written in English and shall be interpreted according to Irish legal standards. If these Terms are translated into any other language, the English version shall prevail in the event of any conflict or ambiguity.

15. Updates and Revisions

RIP Ireland reserves the right to revise, modify, or update these Terms at any time. Changes will be communicated through the platform and become effective immediately upon posting unless otherwise noted. Continued use of the platform indicates acceptance of any revised Terms.

15.1 Right to Amend Terms

RIP Ireland reserves the right to amend, revise, update, or replace these Terms at any time, without prior notice, to reflect changes in the law, regulatory guidance, or business operations. Any such changes will take effect immediately upon posting on our website, unless otherwise stated.

15.2 Notification of Material Changes

Where we make substantial changes to the Terms, we will make reasonable efforts to notify users via:

  • Email, where addresses are available;
  • A prominent notice on the RIP Ireland homepage;
  • Updates flagged on donation or fundraiser creation pages.
15.3 Continued Use as Agreement

Continued use of the RIP Ireland platform following any amendments constitutes acceptance of those changes. If users do not agree with the revised Terms, they should discontinue use of the platform immediately.

15.4 Review Frequency

These Terms are reviewed at least once per calendar year by legal advisors to ensure continued compliance with Irish and European Union legislation, evolving sector standards, and data protection regulations.

16. Third-Party Websites and Content

The RIP Ireland platform may contain links to third-party websites, funeral director pages, or registered charity resources. These links are provided for informational purposes only. RIP Ireland is not responsible for the content, services, or terms of any third-party websites. Access to such third-party resources is entirely at the user’s own risk.

17. Final Disclaimer and Limit of Liability

While RIP Ireland takes every precaution to ensure the integrity, transparency, and lawful use of its platform, we make no guarantee that all user-submitted fundraisers, content, or actions by third parties are free from error, fraud, or misuse.

By using RIP Ireland, all users and visitors accept that:

  • Use of the platform is entirely at your own risk;
  • RIP Ireland cannot be held liable for any indirect, incidental, consequential, or punitive damages arising from any fundraiser, content, or donation;
  • We are not responsible for how funds are spent once transferred to the nominated party;
  • All users are responsible for complying with their own legal obligations.

RIP Ireland is not responsible for any interruptions, delays, or errors caused by system failures, internet outages, or third-party providers. The platform is provided on an “as is” and “as available” basis.

Your continued use of this service indicates full agreement to these conditions. If you do not accept these terms, please do not use the RIP Ireland platform.
